Lemon Laws in West Virginia

A "lemon" is a consumer product or appliance with a defect that significantly impairs its functionality that was sold or leased after January 1, 1987. The state of West Virginia mandates that a manufacturer repair or replace defective vehicles. Your appliance or product must require multiple repairs while under the manufacturer's factory warranty and, in order to deem the defect a substantial impairment, it must render the vehicle unsafe, unreliable for normal use, or it must seriously decrease the market value. If the manufacturer is informed of the defect and is unable to conform the vehicle to the standard expressed in the warranty, a full refund or replacement vehicle of comparable value must be given to the consumer.

We have found that most people believe lemon laws only apply to motor vehicles. This is a common misconception and is true for many state lemon laws but is not true of federal law. Federal Lemon Law applies to all types of consumer products including cars, trucks, SUVs, motorcycles, RVs, boats, computers, and home appliances. Anything that costs $25 or more and came with a written warranty is covered by federal lemon law, more formally known as The Magnuson-Moss Warranty Act. Used vehicles are covered under the federal lemon law if you have a manufacturer's warranty, original or extended. Also covered under this act, and perhaps most importantly so, is a fee-shifting provision. If your vehicle, appliance, or other product is deemed a lemon by the court system, the manufacturer will be required to cover all attorney fees.
