Maryland Lemon Law Eligibility & Repair Presumptions

This is general information, not legal advice. Maryland’s Automotive Warranty Enforcement Act generally covers new or leased passenger vehicles, motorcycles, light trucks within the statutory weight limit, and multipurpose vehicles registered in the state. Coverage applies during the manufacturer’s warranty period, which is the earlier of 18,000 miles or 24 months after original delivery.

To qualify, the defect must substantially impair the vehicle’s use and market value.

The law presumes a reasonable number of repair attempts have been made in any of the following situations:

  • Four or more unsuccessful repair attempts for the same defect
  • 30 or more cumulative days out of service due to repairs
  • One unsuccessful repair for a braking or steering defect that leaves the vehicle out of compliance with Maryland safety inspection laws

Statutory defenses available to a manufacturer include abuse, neglect, or unauthorized modifications to the vehicle.

Maryland Notice, Remedies & Filing Deadlines

Before pursuing a claim, a consumer must notify the manufacturer or factory branch in writing by certified mail, return receipt requested, and give the manufacturer an opportunity to cure the defect. Once proper notice is received, the manufacturer or authorized dealer generally has 30 days to complete the correction.

If the defect isn’t resolved, potential remedies under the Automotive Warranty Enforcement Act include a comparable replacement vehicle or a refund of the purchase price and specified governmental charges, subject to statutory deductions and allowances. A manufacturer-sponsored informal dispute settlement procedure may also be available, though using it doesn’t eliminate your statutory rights. An action under the Act generally must be filed within three years of the vehicle’s original delivery. Federal law, including the Magnuson-Moss Warranty Act, may provide additional avenues depending on the facts of your situation.
