Mississippi Lemon Law Eligibility: Thresholds & Requirements

Mississippi’s lemon law is formally titled the Motor Vehicle Warranty Enforcement Act, codified at Miss. Code Ann. §§ 63-17-151 through 63-17-165. To qualify for protection, your vehicle’s defect must impair its use, market value, or safety. That standard, known as the nonconformity impairment standard, is what separates a covered defect from an ordinary warranty complaint.

A vehicle is presumptively a lemon under the Act if either of these thresholds is met within the warranty period or one year from original delivery, whichever expires first:

  • The same nonconformity has been subject to 3 or more repair attempts without being resolved
  • The vehicle has been out of service for 15 or more cumulative working days

Two procedural steps are required before you can pursue a claim. First, you must report the nonconformity to the manufacturer or its agent during the warranty term or within one year of original delivery. Second, you must provide written notification to the manufacturer, giving it a final opportunity to cure the defect at a designated repair facility. Once that notice is sent, the manufacturer has 10 working days to bring the vehicle into conformity.

Covered Vehicles, Exclusions, & Filing Deadlines in Mississippi

The Mississippi Motor Vehicle Warranty Enforcement Act covers new motor vehicles sold and operated in the state for personal, family, or household use, including demonstrators and lease-purchase vehicles sold with a manufacturer’s warranty. Vehicles sold used may have recourse only if still under an active express warranty.

Vehicles Excluded from Coverage

Several categories fall outside the state law’s coverage:

  • Off-road vehicles
  • Motorcycles and mopeds
  • Parts or components added by a motor home manufacturer

Filing Deadlines & the Breach-of-Warranty Window

The standard filing window under the state lemon law is 18 months from original vehicle delivery or within one year after expiration of the express warranty, whichever comes first. Acting promptly protects access to all available remedies. A separate breach-of-warranty claim may remain available for a longer period: the Mississippi Supreme Court clarified in Broome v. General Motors, LLC that consumers may have up to six years to pursue a breach-of-warranty claim even after the state lemon law window closes.
